AFFIDAVIT OF MARTIN E. DAVIS
I, Martin E. Davis, the undersigned, declare, under penalty of perjury under the laws of
the United States, that to the best of my knowledge the following statements are true and correct.
Background and Experience
1. I am the President and Chief Executive Officer of Cambria Company LLC (“Cambria”).
I have led Cambria since its inception in 2000 when I decided to enter the quartz surface
business after being presented with the opportunity to buy production equipment for quartz
surface products.
2. I have observed firsthand Cambria and the broader quartz surface industry grow from the
beginning to the giant player in the market that it is today. In fact, Cambria was the first
quartz surface producer in the U.S. and was the only quartz surface producer in the U.S. for
many years. As a result, I have extensive knowledge of the quartz surface industry and the
other players operating within that industry, particularly within the U.S. market where
Cambria is based.
3. I received my Bachelor of Sciences in Food Science and Nutrition in 1989 from the
University of Minnesota.
Product Characteristics and Uses
4. Quartz surface products are a mixture of quartz, resin, and other materials that are made
into an extraordinarily hard, non-porous, and resilient surface.
5. Quartz surface products are used in a variety of applications such as countertops, tiles,
bar surfaces, shower and tub surrounds, fireplace surrounds, walls, floors, and bathroom
vanities and other furniture surfaces. They have become an increasingly popular alternative to
quarried surfaces such as granite due to their heat and scratch resistance, low maintenance,
and aesthetic appeal.
6. Because they are essentially non-porous, quartz surface products have negligible water
absorption. As a result, unlike porous stones that absorb water and can foster bacteria growth,
quartz surface products are also suitable for use in places such as commercial buildings,
restaurants, and hospital food service areas.
Production Process
7. Cambria makes quartz surface products at its facilities in Le Sueur, Minnesota
(approximately 45 miles southwest of Minneapolis). Cambria’s facility includes all the
necessary steps to process quartz surface products: (1) mixing; (2) combining; (3) dispensing
and molding; (4) pressing; (5) curing; (6) cooling; and (7) polishing.
8. In the mixing stage, raw materials including silica (e.g., quartz, quartz powder,
cristobalite), resin binder, pigments, and other additives are mixed together.
